STORIES FROM THE GOLDEN AGE

EPULP CONTEST

ELIGIBILITY

The Stories from the Golden Age ePulp Contest (“Contest”) is open to legal residents of the 50 United States and District of Columbia who are 18 years of age or older as of April 1, 2009. Employees of Galaxy Press (“Main Sponsor”)  (“Affiliate Sponsor”) (collectively, the “Sponsors”), their parents, affiliates, advertising and promotion agencies, printers and judges, and immediate families and individuals residing in the same household with any of these employees, are not eligible to enter or win. Void in Puerto Rico and where prohibited or restricted by law. Potential winners may be required to provide proof of legal U.S. residency upon request prior to prize award. No purchase is required to enter or win this Contest. Except where prohibited by law, entry constitutes permission to use winner's name and likeness without further compensation.

ENTRY PERIOD

The Contest begins at 12:00:01 AM Pacific time on the 15th of each month and ends 11:59:59 PM Pacific time on the 14th of the next month (“Entry Period”).

HOW TO ENTER

You will be prompted to fill out the form with the contest question and your contact information so we can notify all the winners. Answer all of the questions on the entry form where indicated. Once you submit the form you are automatically entered once it is verified that you have answered the question correctly. No limit is set as to how often one person can enter. Illegible or incomplete entries will be disqualified. The Sponsors and their employees and representatives are not responsible and shall not be liable for mutilated, illegible, damaged, unintelligible, incomplete, late, misdirected, postage-due, lost or stolen entries; any condition caused by events beyond the control of the Sponsors that may cause the Contest to be disputed or corrupted; and any printing or typographical errors in any materials associated with the Contest. Proof of mailing or submission of any entry will not be considered proof of receipt. Entries will not be returned.

WINNER DETERMINATION

From all eligible entries the Sponsors will determine the Contest finalist.  The Contest finalists will consist of all eligible entries who correctly answer the first question on the entry form. Prizes will be awarded in a random drawing held among finalists.

PRIZES

The winner will receive a Stories from the Golden Age ePulp which is an iPod that is pre-loaded with all 80 audiobooks in the Stories from the Golden Age series. The value of this prize is $750. Winners are not entitled to exchange or transfer prizes or to obtain cash or other substitutes, but the Sponsors in their sole discretion may substitute prizes of equal or greater value due to prize unavailability for any reason. All federal, state and local taxes are the sole responsibility of winners. The prize will only be delivered to addresses within the United States.  iPod is a registered trademark of Apple, Inc., which is not a sponsor of the Contest or affiliated with it in any manner.

ODDS OF WINNING

The Stories from the Golden Age Contest is available to over 100 million Internet users. The odds of winning prizes depend on the number of eligible entries and finalists received.  Many entries will be received, and only one (1) winner will be selected by the panel of judges.

NOTIFICATION

Potential prize winners will be selected and notified by mail, email and/or telephone within the last 2 weeks of each month. If potential prize winner cannot be reached with 3 attempts, does not respond, or an emailed prize notification is returned as undeliverable for any reason, potential prize winner may be disqualified and the next (runner-up) contestant will be selected as a potential prize winner. All prize winners must sign and return Affidavit of Eligibility & Liability/Publicity Releases (where permitted), and/or Prize Acceptance Form, within ten (10) days of receiving such prize claim paperwork (via mail or overnight courier) as a condition of receiving the prize. 

DISQUALIFICATION

Entrants agree not to knowingly damage or cause interruption of the Contest and/or prevent others from participating in the Contest. CAUTION: Any attempt to damage any online service or website or undermine the legitimate operation of the Contest violates criminal and civil laws. If such an attempt is made, the Sponsors may disqualify any entrant making such attempt and seek damages to the fullest extent of the law.

LIMITATIONS OF LIABILITY

Sponsors and their affiliates, subsidiaries, parent companies, advertising and promotion agencies, printers and judges involved in this promotion are not responsible for any inaccuracies in information which may be used in the Contest, for any technical or human error which may occur in the processing of entries, including data entered by entrants, any entry miscommunications such as technical failures related to computer, telephone, cable, and unavailable network or server connections, related technical failures, or other failures related to hardware, software or virus, or incomplete, late or misdirected entries. Any compromise to the fair and proper conduct of this Contest related to a computer virus, or similar type of technical impairment that may affect the proper fairness, security and administration of the Contest may result in the termination, amendment or modification of the Contest, or portion thereof at the sole discretion of Sponsor. Sponsor reserves the right, in its sole discretion, to void any entries of entrants whom Sponsor believes has attempted to tamper with or impair the administration, security, fairness or proper play of this Contest or who acts in a non-sportsman like manner or with the intent to threaten or harass any other person.

GENERAL TERMS

If aspects of the Prize change outside the control of the Sponsors neither the Sponsors nor any other promotional partners furnishing Prize consideration, will be liable or responsible for any such changes and Sponsor reserves the right to substitute a Prize of equivalent or greater value, at Sponsor's sole and absolute discretion, if, for any reason, all or any portion of Prizes, as described herein, are or become unavailable. No transfer of prize to a third party is permitted. No cash substitutions will be offered for prizes. By accepting a Prize, prize winners agree that Sponsor shall not be liable for any injuries, damages or losses of any kind resulting from or in connection with the awarding, acceptance, possession or use of the Prize or any aspects or parts thereof. Prize winners are responsible for paying any necessary State and Federal taxes related to the winnings. If applicable, winner may receive an IRS Form 1099 for the retail value of the prize. The  winner’s first name, last initial, hometown and state will be disclosed in the Golden Gazette which will be distributed as an online newsletter.

NO WARRANTY

THE SPONSORS MAKE NO WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OF ANY PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

USE OF SUBMISSIONS

By submitting content entries or any other content to the website, entrants grant to the Sponsors the royalty-free, perpetual, irrevocable, sublicenseable, non-exclusive, worldwide right (including any moral rights) and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, publicly perform and publicly display (in whole or in part), and/or to incorporate such content in other works in any form, media, or technology now known or later developed, for the full term of any rights that may now or ever exist in such content.

CONDITIONS

By entering the Contest, potential winners agree that Sponsors, judges, their respective parent companies, divisions, affiliates and subsidiaries, and each of their directors, officers, employees, agents, representatives, successors and assigns, and all others associated with the development and execution of this Contest, their officers, directors, subsidiaries or affiliates and their agencies and employees shall not be held liable for any injuries, losses or damages, including death, resulting from participation in this Contest or prize acceptance. All contestants, as a condition of entry into the Contest, agree to release Sponsors, from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, losses of any kind to persons including death or property which may be sustained directly or indirectly with the receipt, ownership, use or misuse of any prize awarded or for any typographical or other error in these Official Rules or with the announcement of or offering of any prize. The winner shall bear all risk of loss or damage to their prize after it has been delivered.

WAIVER

By entering, participant waives all rights to claim punitive, incidental and consequential damages, attorneys' fees or any damages other than actual out-of-pocket costs or losses that may arise in connection with participation in the Contest or acceptance, possession and use of any prize. Where legal, by accepting prize, winner agrees to the use of his/her name, city/state, likeness, photograph and/or voice and statements by winner for advertising/publicity purposes without notice or further compensation. By entering, entrants agree that this Contest is governed by laws of California.

DISPUTE RESOLUTION

Except where prohibited, by participating, you agree that a) any and all disputes, claims and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating, but in no event attorney's fees; and c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplies or otherwise increased.
